Referrer Agreement
These Referral Program Terms & Conditions (the “Agreement”) govern your participation in the referral program (the “Program”) offered by Power Search Solutions LLC (“Recruiter”, “we”, “us”, or “our”).
By submitting a referral and checking the “I agree” box on this page, you (“Referrer”, “you”) agree to be bound by this Agreement.
1. Definitions
Referrer – The individual submitting a candidate’s information through this form.
Candidate – The person you are referring for the position.
Client – The healthcare facility or organization with whom the Candidate may interview and/or accept employment, introduced by Recruiter.
Qualifying Position – The specific job opening identified on this referral page or otherwise confirmed in writing by Recruiter as eligible for this Program.
Start Date – The Candidate’s first day of work in the Qualifying Position with the Client.
6-Month Mark – The date on which the Candidate has completed six (6) consecutive months of continuous employment in the Qualifying Position, as reported to us by the Client.
2. Eligibility to Participate
You must be at least 18 years old and legally able to enter into agreements.
You may not be:
An owner, officer, or authorized hiring decision-maker at the Client for this specific role, or
Someone prohibited by your employer’s policies from receiving referral bonuses.
You may not refer yourself. A “self-referral” is not eligible for any bonus.
You must submit accurate, truthful contact information for yourself and the Candidate.
We reserve the right to request additional information to verify your identity and eligibility.
3. Candidate Eligibility
To qualify under this Program, the Candidate must:
Be someone you reasonably believe may be interested in the Qualifying Position.
Be new to Power Search Solutions – meaning:
Not already in our active database in the last 12 months for the same or equivalent role, and
Not already in active communication with us about this position at the time you submit the referral.
Explicitly acknowledge that you referred them, when asked by us or by the Client.
If multiple Referrers submit the same Candidate, the bonus will be awarded to the first valid referral received, as determined by our records.
4. Referral Bonus Structure
Subject to all terms in this Agreement, you may be eligible to receive the following referral bonuses for a Qualifying Position. The maximum total referral payout of $3,000 applies only to full-time, permanent positions. Travel, per diem, and PRN roles are subject to a separate lump-sum structure described below.
Full-Time / Permanent Positions (up to $3,000 total)
First Interview Bonus – $250
Payable if:
The Candidate completes a scheduled first interview (phone, video, or in-person) with the Client for the Qualifying Position, and
The interview is confirmed as completed by the Client or by Recruiter.
Start Date Bonus – $1,250
Payable if:
The Candidate accepts an offer for the Qualifying Position, and
The Candidate begins employment and completes their first day of work with the Client.
6-Month Retention Bonus – $1,500
Payable if:
The Candidate remains continuously employed in the Qualifying Position for six (6) consecutive months from their Start Date, as confirmed by the Client, and
The Candidate has not resigned, been terminated, or transferred into a role that is not substantially similar to the Qualifying Position.
Travel, Per Diem, or PRN Positions (up to $1,500 total)
For Candidates placed into travel, per diem, PRN, or other non-permanent contract roles, the total referral bonus is a single lump-sum payment of $1,500.
The lump-sum bonus is payable only after the Candidate successfully completes their initial contract or assignment term with the Client, as confirmed by the Client and subject to all other conditions in this Agreement.
Total potential referral payout for a full-time, permanent placement is $3,000 per Candidate who successfully meets all milestones. For travel, per diem, or PRN contract placements, the maximum total referral payout is a single lump-sum payment of $1,500.
5. Conditions for Payment
Referral bonuses are contingent on all of the following:
The Candidate is hired through Power Search Solutions LLC for the Qualifying Position.
The Client successfully pays Power Search Solutions the agreed placement or recruitment fees related to the Candidate’s hiring.
You remain in compliance with this Agreement and any applicable laws or employer policies.
If the Candidate is hired outside of our involvement, or the Client does not pay our fee, we are not obligated to pay the referral bonus.
We reserve the right to:
Verify all employment dates and status with the Client,
Delay payment while verifying eligibility, and
Deny or rescind bonuses in cases of fraud, misrepresentation, or violation of these terms.
6. Payment Method & Timing
Bonuses will generally be paid within 30–45 days after each milestone is confirmed (interview completed, start date, 6-month mark), subject to Client payment and verification.
Payments may be made via check, electronic transfer, or another method reasonably selected by us.
You are responsible for providing accurate payment details.
If a payment is returned or cannot be processed because of incorrect information, we may request updated information and attempt payment again. If we are unable to successfully pay you within a reasonable period, the bonus may be forfeited.
7. Taxes
Referral bonuses may be considered taxable income. You are solely responsible for:
Reporting this income to the appropriate taxing authorities, and
Paying any applicable taxes.
We may require tax documentation (such as a W-9 in the U.S.) before issuing payment, and we may issue tax forms if required by law.
8. No Employment Relationship
Participation in this Program does not create any employment, partnership, or agency relationship between you and Power Search Solutions or the Client.
You are acting as an independent referrer only. You are not authorized to:
Represent yourself as an employee, agent, or representative of Power Search Solutions or the Client,
Make promises or guarantees on behalf of the Client or Power Search Solutions, or
Negotiate offers, compensation, or employment terms on behalf of the Candidate or the Client.
9. Limitation of Liability
To the maximum extent permitted by law:
Power Search Solutions will not be liable for any indirect, incidental, or consequential damages arising from or related to this Program.
In any case, our total liability to you in connection with this Program will not exceed the total referral bonuses actually payable to you under this Agreement.
We do not guarantee that any Candidate will be interviewed, offered a job, hired, or remain employed.
10. Program Changes & Termination
We may, at our sole discretion:
Modify, suspend, or terminate this Program at any time,
Change bonus amounts, eligibility criteria, or payment timing for future referrals, and
Decline participation from any individual for any lawful reason.
Changes will not affect referral bonuses that have already been earned under the terms in effect at the time of the qualifying milestone.
11. Governing Law
This Agreement will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
Any disputes arising under or in connection with this Agreement shall be resolved in the courts of appropriate jurisdiction located in the State of Texas, unless otherwise required by law.
12. Entire Agreement
This Agreement constitutes the entire understanding between you and Power Search Solutions LLC with respect to the referral program and supersedes any prior discussions or representations, whether written or oral, regarding the Program.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
13. Acknowledgement & E-Signature
By checking the “I agree to the Referral Program Terms & Conditions” box and submitting this form:
You confirm that you have read, understood, and agree to be bound by this Agreement.
You represent that you are legally permitted to participate in this Program and to receive referral bonuses.
You agree that your electronic acceptance and typed name constitute your electronic signature and have the same force and effect as a handwritten signature.
